Terms and Conditions of Sale
1. Definitions
In these conditions, these words shall have the following meanings:
- You/ Customer: You as the person named on the order form
- Goods/items: The items that you have ordered on the order form.
- We/ Us /The Company: Arden Architectural Limited and its authorised Officers.
- Working day: Every working day not being either a Saturday, Sunday or Statutory Holiday in the United Kingdom
- Special Order Items: Items which are not within our usual range and which have to be sourced or manufactured to your requirements or specification.
- Contract: the contract for the sale by the Company and purchase by the customer of goods and items.
- Purchase Price: The price that you pay for the goods and items not including delivery.
- Website: Our website www.britishironmongery.co.uk
- Order form: The order form on our website.
2. Conditions
- All orders made by Customers to the Company for the supply of goods and items including Special Order items shall be subject to these terms and conditions.
- All orders must be made using our website using the order form provided.
- No variation of these terms shall be valid unless agreed by us in writing.
3. Statutory Rights
- Nothing in this agreement shall affect your statutory rights as a consumer as granted by the Sale of Goods Act 1979 or generally.
4. Goods Supplied
- We cannot guarantee that the appearance or colour of goods or items will exactly match the physical appearance of such goods or items displayed on our website or goods or items previously supplied.
- We cannot guarantee that items or goods will exactly fit or match goods or items previously supplied. Where goods are hand-made or hand-finished, there will by reason of this be minor variations and differences in their finish.
- We have the right to discontinue any item from our website or range of goods and items without having to give prior notice to our Customers
- Where you request that we supply you with goods or special order items to your specific specification or design, then we shall use our reasonable endeavours to supply those goods in accordance with that specification but we reserve the right to make such changes in that specification or design that are reasonably necessary without prior consultation with you to ensure that they conform to current safety legislation and to make such minor modifications to the design or specification that we consider necessary or prudent.
- You shall for special order items made to your specification and design indemnify us and keep us indemnified in full against all direct, indirect and consequential liabilities, such terms to include without limit, loss of profit, loss of business, damages, costs and expenses incurred by the Company as a result of any defect in the goods or special order items attributable to its design or infringement or alleged infringement of any intellectual rights.
- Where goods supplied have the benefit of a manufacturers guarantee then you should raise any claim under the guarantee with us in the first instance and not the manufacturer directly.
5. Payment
- Payment in full must be made at the time that the Order is placed by you with us.
- The price of goods will be that quoted on the website at the date of the order and includes value added tax at the prevailing rate.
- All payments must be made in pounds sterling
- Title and ownership to the goods ordered only passes to you once payment in full has been made to us.
- You must pay all delivery charges at the time that the order is placed.
- We only accept payment by Credit or Debit Cards or use of your Paypal account via the website.
- Any discount scheme offered to our customers by us at any time can be withdrawn without prior notice and discontinued at any time at our absolute discretion.
6. Delivery
- Delivery will not be made until payment in full has been made.
- Delivery will be made to the address nominated by you on the order form.
- We will make delivery by either the Royal Mail or a nominated courier at our discretion.
- We will aim to dispatch most items ordered (Other than Special Order Items) within 10 working days to addresses within the United Kingdom.
- The risk of loss or damage to the items ordered passes to you upon delivery.
- Where Special Order Items have been ordered, we will endeavour to give you an expected delivery date which will usually be in the region of 5 weeks after the date of your order for brass based products and 7 weeks after the date of your order for iron based products. Such items are individual by their nature and are often manufactured to your specific order by our suppliers. There may consequently be a delay in their dispatch for reasons that are beyond our control.
7. Cancellation of Orders and Returned Goods
- If you wish to return goods or to cancel your order then you must advise us in writing stating whether you wish to have a refund of the purchase price or whether you wish to exchange the goods supplied for alternative goods of an equal value.
- We cannot accept cancellations for Special Order Items manufactured specially to your specification.
- If you are not satisfied with the goods that we have supplied because they are damaged in transit or faulty or defective in manufacture and you wish to return the goods then they must be returned to us within 7 days of delivery and we will give you a refund of the purchase price or replace them with replacement or alternative goods of an equal value at your direction.
- If you wish to return goods that are not faulty or defective then we will give you a refund of the purchase price only or if you wish to exchange those goods for alternative goods of an equal value then you will have to pay the additional delivery costs incurred.
- If you wish to exchange goods purchased that were not faulty for goods of a higher value then you must pay the difference in the purchase price between the goods returned and the replacement goods ordered together with the delivery costs for the replacement goods.
- Goods must be returned in an unused and re-sellable condition unless they are faulty.
- We are not liable to replace any goods or items that have been damaged in their use, fitting or installation unless such damage was attributable to a defect in its manufacture.
- We cannot accept returns for items manufactured specially for your order, unless such items are defective or faulty.
8. Warranties
- The company does not warrant that the goods are suitable for any particular purpose even if that purpose is or has specifically been made known to the company, The buyer shall assume all responsibility for ensuring to its own satisfaction that the goods to be supplied are suitable for the purpose to which they are to be put, whether by the buyer or third party.
9. Applicable Law
- The relevant law to this agreement is that of England and Wales.
